1. Acceptance of These Terms
These Terms of Service (the “Terms”) govern your access to and use of the Nooit in Paniek B.V. website and any related pages, forms, and materials (together, the “Site”), as well as our online education programmes and virtual workshops (the “Services”). By accessing the Site or requesting information, registering interest, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
If you do not agree, do not use the Site or Services. If you are using the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
Minimum age: the Site and Services are intended for individuals aged 16 or older. If you are under 18, you must use the Site under the supervision of a parent or legal guardian who agrees to these Terms.
2. Educational Scope and Important Disclaimers
Nooit in Paniek B.V. provides online professional education focused on workplace skills such as communication, leadership, productivity, emotional intelligence in professional settings, and organisational effectiveness. The Services are educational and informational only.
- Nooit in Paniek B.V. is not a healthcare provider and does not provide medical care, psychological treatment, psychotherapy, counselling, diagnosis, or crisis intervention.
- The Services do not provide legal, financial, accounting, recruitment, or consulting services.
- Participation does not guarantee employment, promotions, career advancement, certifications, improved health outcomes, or financial results. Outcomes depend on context and on how learners apply the material.
- Any examples, case studies, or templates are provided for learning purposes and may not be suitable for every workplace, role, or jurisdiction.
If you require medical, mental health, or crisis support, you should contact local emergency services or a qualified licensed provider in your jurisdiction. If you require legal or financial advice, you should consult a licensed professional.
3. Description of the Site and Services
The Site describes our online courses, workshops, learning resources, and registration or enquiry pathways. Some parts of the Services may be instructor-led (scheduled sessions), and others may be self-paced (modules and exercises). The exact format, schedule, and included materials can vary by programme.
We may update, improve, remove, or discontinue any part of the Site or Services at any time. Where changes materially affect an active programme cohort, we will aim to provide reasonable notice and a practical transition path.
The Services are delivered online and are available across Canada. Nooit in Paniek B.V. is a Netherlands entity and operates from its registered address in the Netherlands.
4. Registration, Enquiries, and Communications
When you submit a registration or enquiry form, you agree to provide accurate and up-to-date information. You also agree that we may contact you using the details you provide to respond to your request, coordinate programme access, or clarify registration details.
You must not submit information that is unlawful, misleading, defamatory, or infringing. Please do not include sensitive personal information in free-text fields. We do not request special-category data (such as health data) for educational enrolment.
Electronic communications: by using the Site, you consent to receiving communications from us electronically. Notices may be provided by email or by posting on the Site. Electronic communications satisfy any legal requirement that such communications be in writing.
5. Acceptable Use
You agree not to misuse the Site or attempt to interfere with its normal operation. In particular, you must not:

We may suspend or restrict access to the Site if we reasonably believe your use creates security risk, legal exposure, or disruption to other users.
6. Intellectual Property
The Site and its content, including text, curriculum descriptions, templates, frameworks, design elements, and any downloadable materials, are owned by or licensed to Nooit in Paniek B.V. and are protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access the Site for your personal or internal organisational evaluation and learning purposes. You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, or commercially exploit the Site or materials without our prior written permission, except where explicitly allowed in a specific programme’s licence terms.
Any trademarks, service marks, and logos appearing on the Site are the property of Nooit in Paniek B.V. or their respective owners.
7. Third-Party Services and Links
The Site may reference third-party services that are commonly used for online learning delivery (for example, video conferencing tools) or may provide links for convenience. Third-party services are governed by their own terms and privacy policies. Nooit in Paniek B.V. is not responsible for third-party content, policies, or practices.
Links do not imply endorsement. If you access third-party services, you do so at your own risk.
8. Disclaimer of Warranties
The Site and Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any educational materials will meet every learner’s needs. Educational content is general and may require adaptation to specific workplace contexts.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Nooit in Paniek B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, goodwill, data, or business opportunities, arising out of or related to your use of (or inability to use) the Site or Services.
To the maximum extent permitted by applicable law, our total liability for all claims arising from or related to the Site or Services shall not exceed the greater of: (a) the amounts you paid to Nooit in Paniek B.V. for Services in the twelve (12) months before the event giving rise to the claim, or (b) one hundred euros (€100).
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intentional misconduct or gross negligence where such limitation is not permitted.
10. Indemnification
You agree to indemnify and hold harmless Nooit in Paniek B.V., its directors, officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site, (b) your violation of these Terms, or (c) your submission of unlawful or infringing content through Site forms.
11. Force Majeure
We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, labour disputes, public health emergencies, internet or telecommunications outages, cyberattacks, and failures of hosting or cloud providers.
12. International Use
The Site is operated from the Netherlands. The Services are available online across Canada, but the Site may be accessible from other locations. We make no representation that the Site or Services are appropriate or legally available in every jurisdiction. You are responsible for complying with local laws that apply to your access and use.
13. Governing Law and Jurisdiction (Netherlands)
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of the Netherlands, without regard to conflict-of-laws rules.
Unless mandatory consumer law provides otherwise, the competent courts of the Netherlands shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
If you are a consumer resident in the European Union, you may also have rights to bring proceedings in the courts of your place of residence, and mandatory consumer protections of your country of residence may apply.
14. Dispute Resolution
Before starting formal proceedings, you agree to contact us and allow a reasonable period of thirty (30) days to attempt to resolve the matter informally. Informal resolution requests should be sent to [email protected] with a clear description of the issue.
Nothing in this section limits any statutory rights you may have, including consumer rights that cannot be waived.
15. Termination
We may suspend or terminate your access to the Site if you violate these Terms or if your use creates risk for the Site’s security or reliability. Termination may occur without prior notice where immediate action is reasonably required.
Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and any provisions that by their nature should survive termination will survive.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and Nooit in Paniek B.V. regarding the Site and Services, and supersede any prior or contemporaneous communications on the same subject.
18. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, corporate reorganisation, or sale of assets.
19. No Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of Nooit in Paniek B.V.
20. Modifications to These Terms
We may update these Terms from time to time to reflect changes to the Site, the Services, or legal requirements. Updated Terms will be posted on this page with a revised “Last Updated” date. Changes become effective fourteen (14) days after posting, unless a change is required by law or is necessary for security or operational reasons, in which case it may take effect immediately.
